Administrative Review

Received an eligible Home Office refusal? We provide initial case triage and referral to specialist solicitors for Administrative Review advice.

If the Home Office has refused an application and the decision appears to contain an error, Administrative Review may provide a way for an eligible decision to be reconsidered.

Not every refusal carries a right to Administrative Review. The starting point is understanding the decision you have received, the deadline that applies and what options are available to you.

Knightsbridge Immigration can undertake an initial case triage and, where specialist advice is required, refer your matter to an appropriately authorised solicitor.

About Administrative Review

Administrative Review is a process through which the Home Office reviews certain eligible decisions to determine whether a caseworking error was made.

It is different from making a new visa application and different from an immigration appeal.

Your decision letter should normally tell you whether Administrative Review is available.

Understanding Your Decision

Before deciding what to do next, it is important to understand:

  • what application was refused;
  • the reasons given by the Home Office;
  • whether Administrative Review is available;
  • the deadline stated in the decision;
  • whether another immigration application is being considered; and
  • whether there are wider issues within your immigration history.

Administrative Review should not automatically be treated as the best response to every eligible refusal. The circumstances of the case need to be considered carefully.

How Knightsbridge Helps

Our role begins with initial case triage.

We can take details of your immigration history, obtain the Home Office decision and organise the relevant documents so that the appropriate next step can be identified.

Where the matter requires advice beyond the level at which Knightsbridge Immigration is authorised, we can, with your agreement, refer the case to one of our solicitor partners.

The solicitor will independently assess the case. If they agree to act, they will provide the legal advice, issue their own client care documentation and confirm their professional fees directly with you.

Knightsbridge may continue to provide agreed administrative support where appropriate.

Time Limits Matter

Administrative Review deadlines can be short.

For many decisions, an application made from within the UK must currently be submitted within 14 days of receiving the decision, while an overseas application may have a 28-day period. Different provisions can apply in particular circumstances.

The deadline in your decision should therefore be checked immediately.

Situations Requiring Closer Analysis

Particular care may be required where there are:

  • previous refusals or immigration breaches;
  • allegations of false information or deception;
  • disputed documents or evidence;
  • several reasons for refusal;
  • another application being considered;
  • questions about whether Administrative Review is the appropriate remedy; or
  • an approaching or expired deadline.
