Switching UK Immigration Routes
Your plans may have changed since your current visa was granted. You may have a job offer, be finishing your studies or be considering permission based on your relationship.
Switching UK immigration routes means applying for permission under a different category while you are in the UK. Before taking that step, you need to know whether an application from inside the UK is allowed, whether you meet the new route’s requirements and what the change would mean for your family and longer term plans.
Knightsbridge Immigration can help you understand those questions and the work your application would involve.

Can you switch without leaving the UK
Being eligible for a visa and being allowed to apply for it from inside the UK are separate questions. The answer depends on both your current immigration position and the route you want to enter.
For example, someone with Visitor permission cannot ordinarily switch to the Skilled Worker route from inside the UK. A Student considering Skilled Worker permission must also meet the rules governing when that change is allowed.
Family applications have their own restrictions and exceptions. Having a British partner does not, by itself, establish that an application can be made from inside the UK.
Your proposed route therefore needs to be checked against the permission you currently hold, your immigration history and the requirements that apply when you intend to submit.
If you are continuing on the same route, our Further Leave to Remain page may be the better starting point. A change of employer can also require an application without being a change of immigration route.
Check the timing before making commitments
A job start date, course ending or family change can make a new application feel urgent. The immigration timetable still needs to work.
Start with the expiry date and conditions of your current permission. Then establish when you can meet the new route’s requirements and whether the necessary sponsorship, evidence and application steps can be completed in time.
A valid application made before permission expires can extend your existing permission under section 3C while it remains undecided. The existing conditions generally continue. Applying for a different visa does not automatically give you its work rights.
Starting an online form or contacting an adviser does not amount to submitting an application. If your permission is close to expiring, make the date clear when seeking advice.

Consider your family and settlement plans
A route change should be assessed against what you want to do next and where you hope to be later.
Your partner or children do not automatically move onto your new route with you. Their eligibility, existing permission and application timing need separate consideration. A route that works for the main applicant may have different rules for dependants.
Switching can also affect progress towards Indefinite Leave to Remain. Some settlement routes allow specified periods on different routes to be combined. Others require time on a particular route. Previous residence is not automatically lost, but it should not automatically be counted either.
Before choosing, consider the practical effect on:
- Your work, study or business plans.
- Your partner’s and children’s immigration position.
- The residence that may count towards settlement.
- Application fees, any Immigration Health Surcharge and professional fees.
- Travel or other commitments that depend on the decision.
These questions can change which option is appropriate, even where more than one route appears available.
If another application or fee waiver request is pending
An outstanding application needs to be considered before submitting a different one.
A later application may operate as a variation of the first. Withdrawing an application can affect the permission you rely on. Have the sequence checked before cancelling, replacing or changing an existing application.
Fee waiver requests require particular care when plans change. Under the current rules, an application on a different route does not inherit the date of an earlier fee waiver request. It is dated when the new application is submitted.
Our fee waiver timing guide explains why the route and sequence matter. A fee waiver request should not be treated as general protection for any later application.
Check travel separately
For an ordinary application for permission to stay, leaving the Common Travel Area before a decision normally results in the application being treated as withdrawn. The Common Travel Area includes the UK, Ireland, the Channel Islands and the Isle of Man.
Section 3C permission ends on departure from the UK, a narrower boundary. A trip within the Common Travel Area can therefore still affect your permission.
Check the effect of departure on your application, your status and your ability to return before making travel arrangements. Our guide to travel while an application is pending explains the distinction.
How Knightsbridge can help
The useful starting point is the relationship between your current permission and the route you are considering.
For work we agree to undertake, that means considering the applicable requirements, identifying evidence that needs attention and explaining the timing issues relevant to the application. Where there is a choice of routes, the discussion should also address the consequences for your family and settlement plans.
The appropriate service will depend on how much work is needed. You may need advice on the proposed change, a review of an application you are preparing or full representation. We confirm the scope and professional fee before agreed work begins.
If the matter requires advice or representation outside our authorisation, we explain the need for an appropriately authorised specialist.
Discuss the route you are considering
Tell us which permission you currently hold, when it expires and which route you want to move to. Mention any pending application or fee waiver request, dependants and dates affecting your plans.
If you are unsure which route fits, explain what you want to do in the UK. That gives us a useful starting point for identifying the assistance you need.
