Would your settlement application still make sense if someone checked your dates, salary and employer’s letter separately?

Daniel thought the hard part was reaching five years. Then HR sent a settlement letter using his old working hours. Nothing dramatic had happened: the team had changed its working pattern and the template had not caught up.

For a Skilled Worker approaching ILR, five years is usually the milestone everyone remembers. The application also depends on qualifying permission, continuous residence, the right salary rules and confirmation from the sponsor. Each part needs to support the same account of your position.

This guide is for a main applicant preparing an ordinary Skilled Worker settlement application, including eligible Health and Care Workers. It helps you organise the decisions that come before completing the form. Dependants have their own requirements, even when the family hopes to apply together.

Establish the qualifying history and settlement salary basis

The current Skilled Worker settlement rules require a continuous five-year period made up of permitted categories. Certain other work routes can count in combination. Student and Graduate permission do not ordinarily become qualifying Skilled Worker settlement time because you later obtained sponsorship.

Start with all grant decisions, not just the latest visa. Identify the route held during each period and any time between entry clearance and arrival. A change of employer does not automatically restart the qualifying period, but the permission and sponsorship history still need to be correct.

Our ILR application date guide explains how to separate grant, arrival and expiry dates. Avoid choosing a submission date from the employment start date alone. Working for the same company for five years and holding five years of qualifying immigration permission are related facts, but they are not interchangeable.

Daniel’s grant history contains qualifying work permission throughout the five years under review, including a properly authorised employer change. The file records the permission dates separately from his company joining date. His earlier Student permission is left outside this five-year calculation. That gives the later salary review an established residence history to work with.

The salary accepted for a previous visa is not a permanent promise that the same figure will support settlement. The current settlement table has different rows for different circumstances, including transitional and specified occupation provisions.

Under the general row, the salary must meet both the general threshold and the relevant going rate. A higher going rate can therefore be decisive. Other rows have their own conditions. You should not select a lower figure simply because it appears in an online article or because you previously qualified as a new entrant.

The Skilled Worker ILR salary requirements guide works through this assessment in detail. For preparation, gather the latest certificate of sponsorship details, occupation code, contracted hours, basic pay and relevant grant history. A salary increase should be real, properly documented and reflected in the evidence. An unexplained letter promising a figure that payroll does not support creates another question.

Ask the sponsor for the right confirmation

Your most recent sponsor must remain approved to sponsor Skilled Workers at the date of decision. The sponsor must confirm that it still needs you for the foreseeable future and that you are paid, and will continue to be paid, at the required level.

The letter should describe your actual circumstances. Check your name, job, occupation information, hours and pay against the employment and sponsorship records. If the job has changed, the appropriate immigration and sponsor compliance questions need addressing, rather than being hidden in a settlement letter.

The letter should be requested once the salary position has been checked, with enough time for the employer to confirm accurate facts. HR may understandably use a standard template. You remain responsible for ensuring that the application evidence fits your case. Our ILR evidence guide explains how to assess what a document actually establishes.

Daniel’s contract now records 40 hours; HR’s first draft still says 37.5. The difference matters because the going rate may need adjusting for hours. He supplies the current contract and asks HR to confirm the actual hours, basic salary and continuing need for his role. The salary assessment is completed using the appropriate settlement row, and the corrected letter agrees with payroll. No one changes the description merely to obtain a lower rate.

This is the point at which the employer evidence earns its place. It connects the salary calculation to a current job and a continuing sponsor. A letter that simply says “eligible for ILR” would leave those facts unstated.

Reconstruct travel before applying the absence rule

Skilled Worker settlement uses Appendix Continuous Residence. The ordinary rule concerns no more than 180 days outside the UK in any rolling 12-month period, subject to the applicable provisions. Counting only January to December can miss a problem across two calendar years.

Prepare a trip list with full departure and return dates. Include business travel and visits to relatives. Compare it with passports, booking records and your employer’s records where available. Our ILR absence rules guide explains how the rolling assessment differs from a simple annual total.

Do not assume that paid work abroad is excluded because your employer required it. Where a possible exception, historic rule or unusually long absence matters, have that assessed properly. Ordinary preparation should establish that the requirements are met. It should not depend on an unexamined hope that a sympathetic explanation will be enough.

Complete both knowledge requirements for the submission date

At the date of writing, the main Skilled Worker settlement position before 26 March 2027 generally relies on English having been demonstrated for the visa. Published rules introduce a B2 speaking and listening requirement for settlement applications made on or after 26 March 2027, unless an exemption applies.

That change matters for somebody who qualifies next spring. It also matters if an intended earlier application is delayed. Read the route provision and evidence rules for the date you will actually apply, rather than relying on a checklist saved several months earlier.

Our English evidence for ILR guide explains the available evidence questions. Do not assume that holding a B1 result will automatically meet a later B2 requirement. There may already be suitable evidence, but its level, category and acceptance need checking before you decide whether another test is necessary.

Most applicants aged 18 to 64 need to meet the Life in the UK requirement unless exempt. Passing an English test is not a substitute. The test has its own booking, identity and result requirements.

Use the Life in the UK Test guide to plan this part. Allow enough time to prepare without making the application timetable depend on one last available appointment. Keep the result reference and ensure your identity details can be matched across your records.

An old passport used for an earlier test may still explain the identity history, even where you now hold a replacement. A name change should be evidenced rather than left for the decision-maker to infer. These are manageable administrative issues when addressed early. They become distracting when discovered after the application has been submitted.

Give each dependant an individual settlement check

Your five-year milestone does not settle your partner’s residence calculation. A dependant who joined later may need further permission. A child’s position depends on the relevant child requirements and the parents’ circumstances, rather than an adult partner calculation copied across.

Our Skilled Worker dependant ILR guide explains the separate qualifying position. For children, start with whether ILR or British citizenship registration is the relevant next step. A UK-born child may need a nationality assessment once a parent settles; that does not make every child automatically British.

In a fictional example, Daniel qualifies in December, while his partner, Leila, joined two years later. Their household plan has two decisions: Daniel’s settlement application and Leila’s continuing permission. Treating them as one settlement application would miss the practical issue. The family needs a timetable for each person and a budget covering the applications actually required.

Plan the cost and the waiting period

ILR currently costs £3,226 for each applicant. There is no Immigration Health Surcharge for the settlement application itself. Tests, optional appointment services, any available faster decision service and professional assistance can create separate costs.

Check the current ILR fees and processing guide before paying. Priority availability and timing depend on the application category and identity process. Official pages can present different service descriptions, so confirm the option and target actually offered for your application. Faster processing cannot resolve missing eligibility.

An ordinary settlement application may take months. Consider whether the evidence, employment position and family arrangements are ready for that period. Keep funds for any dependant extension that is still needed. Spending the entire household budget on the main applicant’s settlement can leave another person’s approaching expiry unaddressed.

Read travel while an ILR application is pending before arranging work or family trips. For an in-country application for permission to stay, travel outside the Common Travel Area before a decision can cause withdrawal. An urgent journey therefore needs a decision about the application and current permission, not simply permission from your employer.

The Common Travel Area distinction should not be treated as a blanket assurance that any journey within it is straightforward. Consider your immigration position, identification requirements and the route of travel. A connection through another country can matter.

Keep the employer informed of any period when international work travel needs review. If a decision arrives, check the grant and digital status before assuming the trip can proceed. The approval email, the status record and the identity document used for travel should all be understood.

Finish with one coherent application record

Daniel’s final review brings together four records: the qualifying-permission chronology, the absence schedule, the settlement salary calculation and the corrected sponsor letter. The same hours and pay appear in the form and employment evidence. His test records are identifiable, and his planned submission is within the permitted period.

Leila’s later arrival remains a separate decision. Their budget includes her continuing dependant permission rather than assuming Daniel’s ILR application settles them both. They also keep the period after submission clear of unreviewed overseas work trips.

Through Knightsbridge’s ILR service, a Case Assessment can establish which part of that preparation you need help with. Provide the relevant grants, current sponsorship and employment details, travel record and family expiry dates. For suitable ordinary matters, the next service can then be scoped around a clear task: establishing eligibility, reconciling evidence or preparing the application. Its fee and responsibilities should be agreed before the work begins.
