Can you switch from a Student or Graduate visa to an unmarried partner visa from inside the UK?
It may be possible if the applicant can apply in-country, the other partner has a status that qualifies as a sponsor, and the relationship and remaining family-route requirements are met. Holding a Student or Graduate visa does not itself make the partner eligible to sponsor you.
First identify who is applying and whose immigration status supports the family application.
Separate the applicant’s status from the sponsor’s status
This is the first point to get right. In a switch from Student or Graduate permission, the person on that visa is usually the applicant. Their partner in the UK must be a qualifying sponsor under the family route, such as a British or Irish citizen, a person settled in the UK, someone with a listed form of pre-settled status, or a person with another status included in the Rules. A partner who is merely a Student or Graduate visa holder will not normally qualify as a sponsor for an Appendix FM partner application on that basis alone.
Couples often use “my partner has a visa” as shorthand for sponsor eligibility. The family route does not treat all UK visas alike. A Student or Graduate permission may allow the holder to live and work in the UK, but it does not mean they are settled or eligible to sponsor a partner on the family route. Some work routes have their own dependant provisions, which are different from an unmarried partner family visa.
Check the current categories in the GOV.UK partner visa guidance before planning a switch. For comparison, a Student’s dependants are addressed under the separate Student visa dependant route. The Knightsbridge Unmarried Partner Visa page explains the family route; this article focuses on people who currently hold Student or Graduate permission.
Can the applicant apply from inside the UK?
In-country switching depends on the person’s current immigration status and the specific restrictions in the Rules. Some categories, including visitor status and certain short-term permissions, generally cannot switch to a partner route from inside the UK. Student and Graduate permission are not the same as visitor permission, but the exact rule must be checked against the applicant’s grant and any conditions or pending application.
Do not rely on a general statement that “you can switch from any visa”. Check the current Appendix FM requirements, the applicant’s eVisa, leave expiry date and whether an application or appeal is pending. If the applicant’s current permission was granted under a route with special restrictions, or if they have overstayed, the analysis may change. A person with a complex immigration history should obtain advice before submitting a form.
Timing matters. A valid application submitted before current leave expires may extend existing leave under section 3C while a decision is pending, if the statutory conditions are met. An invalid application, an application made after expiry, or travel outside the Common Travel Area while an application is pending can have serious consequences. Confirm the process and consequences before applying. This article is not a substitute for checking the applicant’s precise status record.
The unmarried partner test still applies
Changing immigration route does not remove the relationship requirement. The couple must meet the applicable definition of unmarried partner, including a relationship similar to marriage or civil partnership for at least two years before the application. This is not always two years of cohabitation, and some couples qualify while living apart for work or study, but the relationship’s duration and durability must be evidenced.
Use a timeline to identify when the qualifying relationship began, any time living apart, and any genuine break. The applicant’s course dates or Graduate visa grant may help explain location and life plans, but they do not set the start date automatically. Read When Does the Two-Year Unmarried Partner Period Start? and the separate article on work or study keeping partners apart.
The relationship must also be genuine and subsisting at the application date, both partners must intend to live together permanently in the UK, and any previous relationship must have permanently broken down under the applicable rules. If either partner was married before, review the previous marriage article and explain the timeline accurately.
Financial, English and accommodation requirements
A switch is still a partner application, so the relevant financial requirement usually applies unless a specific exception or route applies. The current threshold, any transitional arrangement, permitted income sources and documentary rules should be checked on the intended application date. An applicant’s Student or Graduate earnings do not automatically count: work permission, job history and the financial category must be considered. The sponsor’s income may also be used where it meets the Rules.
Start with the official partner financial requirements and then identify which person’s income is being relied on. Our companion article, Whose Income Counts for an Unmarried Partner Visa?, focuses on that question. Use the live Knightsbridge financial requirements guide for the full route analysis.
The applicant may also need to satisfy the English language requirement, unless exempt or relying on another permitted basis. Accommodation must be suitable for the couple and any children. Review each item as part of the same route assessment; meeting the relationship test alone is not enough.
When should a Student or Graduate applicant switch?
Compare the current visa expiry date with the time needed to prepare the family application. A Graduate visa may have a longer remaining period than a Student visa, but that does not mean the applicant should postpone planning. The sponsor’s status, income, relationship evidence and child arrangements can take time to verify. If the sponsor is approaching settlement or a status change, consider whether the application timing affects eligibility.
Students should consider course commitments and whether a switch changes any dependants’ position. If a spouse or child currently has Student dependants permission, their future route may need a separate application. Check the expiry dates for every family member, not only the principal applicant. Do not assume one person’s switch automatically changes another person’s visa.
Applicants should also compare the long-term route consequences. A family partner application may put the applicant on a five-year or ten-year family route depending on the facts and decision. Time already spent as a Student or Graduate does not normally count toward the five-year partner settlement period, although a person may qualify under a different route or combination of routes. The relevant start date is generally the grant of partner permission. See the ILR guide before making a decision based only on short-term convenience.
Worked example: Graduate applicant and settled sponsor
Suppose Jamie holds a Graduate visa and has been in a relationship with Morgan for three years. Morgan has indefinite leave to remain. Jamie may be able to apply in-country as an unmarried partner if the in-country application rules permit it and all partner requirements are met. Jamie’s Graduate status is the current permission being switched from; Morgan’s settled status is the status supporting the sponsorship. Jamie’s salary may or may not be usable depending on the financial rules and evidence category.
Now change one fact: Morgan also holds a Graduate visa and has no other qualifying status. The couple should not assume the same Appendix FM family application is available just because both are lawfully in the UK. They should investigate the applicable dependant route or future status options instead. These examples illustrate the sponsor distinction and are not guarantees of eligibility.
Common errors to avoid
The most common mistake is confusing permission to live in the UK with permission to sponsor under the family route. Next is assuming two years of cohabitation are mandatory or, at the other extreme, assuming any two-year dating history qualifies. A third is treating a current Student or Graduate job as automatically countable income. Each question has its own rule.
Another risk is applying at the last minute without checking whether a child or dependant needs to apply at the same time. A route change can affect family members’ status and work or study rights. Ask what happens to each person if the application is granted, refused or invalid before submitting.
Knightsbridge view: verify the sponsor first
We would begin by checking the sponsor’s exact immigration status, not the applicant’s current visa label. If the sponsor is not in an eligible category, relationship evidence cannot cure that issue. Once sponsor eligibility is confirmed, we would test the applicant’s ability to apply in-country, the two-year relationship date, financial category, English requirement and any dependants’ positions.
This order is efficient because it identifies a threshold issue early. It also avoids clients spending time assembling extensive relationship documents for a route that is not available on the sponsor’s current status. Where a sponsor is expected to become settled soon, timing can be strategically important, but the future outcome and date should not be assumed.
Frequently asked questions
Can my Student visa partner sponsor an unmarried partner visa? A Student visa is not ordinarily a qualifying Appendix FM sponsor status. Check the specific route and whether a dependant application is the correct option.
Can a Graduate visa holder switch to a partner visa? In-country switching may be possible if the partner is a qualifying sponsor and all application rules are met.
Does Student or Graduate time count toward partner ILR? It generally does not count toward the five-year partner route, which usually begins with partner permission. Check the full immigration history.
Can I keep working while my family application is pending? A valid in-time application may preserve the conditions of existing leave under section 3C. Check the status and conditions before relying on continued work permission.
What to do next
Confirm the sponsor’s status, applicant’s visa expiry, relationship start date, financial sources and any dependants’ leave. Then review the main route page. For a case involving sponsor status or an urgent expiry, request a Knightsbridge Case Assessment before applying; any application work is separately agreed.
