When does the two-year period for a UK unmarried partner visa start?

It starts when the couple’s relationship became similar to a marriage or civil partnership, not automatically on the date they first met, began dating, moved in together, became engaged or opened a joint account.

The question is whether the required durable relationship existed for at least two years before the application date. Choosing and evidencing that date is often the first real eligibility decision.

What the two-year rule measures

For the family route, an unmarried partner must have been in a relationship with the sponsor similar to marriage or civil partnership for at least two years before the application. The two years describe the length of the qualifying relationship. They are not a universal rule that every couple must have shared a home for exactly two years. GOV.UK says a couple may qualify where they have been in a relationship for two years but cannot live together, for example because work or study keeps them in different places or cohabitation is not accepted in their culture.

The distinction matters because an old photo from a first date may show when two people met but not when their relationship became committed and durable. A tenancy agreement may show cohabitation from a later point but does not necessarily mean the qualifying relationship began only then. The application needs a coherent account of the relationship’s development and enough reliable evidence to support the date put forward.

The current route is described in the GOV.UK partner visa guidance and the Rules in Appendix Relationship with Partner. The Knightsbridge Unmarried Partner Visa page gives the route overview. The decision date is the application date, so calculate backwards from the date you plan to submit rather than from a hoped-for future decision.

Milestones that may help, but do not decide the date alone

Couples often point to a memorable event: the first meeting, first trip together, introduction to family, exclusivity conversation, first period of living together, engagement, or the date they started sharing expenses. Each can be relevant. None is a legal shortcut. A relationship may have become durable before cohabitation, while a couple may have shared accommodation before their relationship had become akin to marriage or civil partnership.

Consider the whole pattern. When did both partners understand the relationship to be committed? How did they organise their lives around it? Did they make sustained plans, maintain regular contact, spend time with each other’s families, share responsibility or make decisions together? Were there long breaks or periods when the relationship had ended? The point is not to prove that every feature of married life was already present, but to explain why the relationship had the required character and continuity.

A couple should avoid selecting the earliest possible date merely to cross the two-year threshold. If the evidence shows casual dating for a year followed by a committed partnership later, a claim that the qualifying relationship began on the first date may undermine credibility. A later but well-supported date is more useful than an earlier date that cannot be explained consistently.

How to build a reliable chronology

Create a simple timeline with the key events and the source that supports each one. It may include when the relationship became exclusive, periods spent in each country, visits, shared accommodation, important family events, any temporary separation and plans made together. Add exact dates where records exist and month or season where the exact date is not known. Do not manufacture precision from memory.

Then compare that timeline against the documents already available. Travel bookings may establish visits; messages can show continuity and shared decisions; letters from friends may explain social recognition; tenancy and utility records can confirm periods at an address. Each item supports only what it actually records. A booking does not prove a trip took place, and a joint bill does not by itself prove the quality or duration of a relationship.

Statements from both partners should explain the same history in their own words. They need not use identical phrases, but the dates and central events should align. If the couple remembers the start differently, say so and explain the basis for the date chosen. A mismatch can be resolved by distinguishing first meeting from the beginning of the committed relationship.

Does time living apart count?

Living apart does not automatically stop the relationship clock. A couple may be separated geographically because of work, study, immigration status, caring duties, finances or cultural expectations and still be in a durable relationship. But the explanation should show ongoing commitment through the period, rather than simply state that the couple remained together.

Evidence may include visits, regular communication, shared plans, financial or practical support, involvement in each other’s families and a clear explanation of why the couple could not live together. These are possible forms of evidence, not a mandatory checklist. Some couples will have records that naturally arise from travel or shared responsibilities; others will rely more on statements and a smaller set of meaningful documents. The aim is to answer the caseworker’s questions without forcing a couple into a document pattern that does not fit their lives.

For the separate issue of work or study keeping a couple apart, see how to evidence a relationship when work or study keeps you apart. The existing live articles Love Actually: relationship evidence and when relationship evidence is not straightforward cover broader evidence principles, including why there is no single document checklist for every couple.

What if the relationship was on and off?

A short period apart does not necessarily mean a relationship ended, but a genuine breakup can affect whether the couple can count a continuous two-year period. Explain any separation honestly: when it started, whether the partners considered the relationship ended, what contact continued, and when or how they reconciled. The legal question is not answered by labelling every difficult period a “break”. The facts and the couple’s understanding matter.

If either partner had a separate marriage or relationship, the two-year date is not the only issue. Previous relationships may need to have permanently broken down, and the evidence and legal timing can be important. Read the focused guide to previous marriages and relationships before assuming that a divorce certificate alone resolves the matter.

Where the couple has not yet reached two years, the unmarried partner route may not be available on the intended date. That does not mean the relationship is not genuine or that no other route exists. Depending on the couple’s plans, a fiancé route or a later application may be relevant. Compare the fiancé and unmarried partner routes and the main fiancé visa page.

Worked example: meeting date versus qualifying date

Suppose Priya and Alex met at a conference in March 2023, began dating in April, and agreed in September 2023 that they were committed partners. They lived in different cities for work until they moved in together in June 2024. If they plan to apply in October 2025, the key question is whether the evidence supports a relationship similar to marriage or civil partnership by October 2023, not whether they can produce a photograph from March 2023. They should explain the September commitment and show how the relationship continued through distance, then avoid claiming that cohabitation began before it did.

This example is illustrative only. Different facts may support a different date. The useful method is to identify what changed in the relationship, decide which date is honestly supportable, and check that at least two years will have elapsed by submission.

Knightsbridge view: the best start date is the one the evidence can explain

We recommend treating the two-year calculation as a chronology question, not a race to find the oldest record. First identify the event or period when the relationship became committed and durable. Then test that position against the couple’s own accounts, travel and address history, communications, family context and periods of separation. If the case depends on a date that is only a few weeks before the application, the margin for uncertainty is small and the submission should be especially clear.

Do not delay a decision until the last minute if the couple is close to the threshold. Application preparation takes time, and the relevant date is the date of a valid application, not when the couple starts gathering documents. At the same time, there is no benefit in filing early if the required period has not yet elapsed. A short assessment can help distinguish a real timing gap from a misunderstanding about cohabitation.

Frequently asked questions

Does the two years start when we first met? Not automatically. The date should reflect when the relationship became similar to marriage or civil partnership and be supported by the overall history.

Must we live together for two years? No, the family route can accommodate couples who have a two-year relationship but cannot live together for specified reasons. The relationship still needs to be durable and evidenced.

Can an engagement date count? It may be useful evidence of commitment but does not automatically define the start of the qualifying relationship.

Can we submit exactly on our two-year anniversary? The requirement is at least two years before the application date. Check the dates carefully and ensure the application is validly submitted on or after the threshold.

What to do next

Write down the proposed relationship start date, the evidence supporting it and any period apart or break. Compare the date with your intended application day. If the timing is close or the history includes separation, use a Knightsbridge Case Assessment to identify the route and evidence issues before applying. Any application preparation or representation is separately agreed.
